Please read these Terms and Conditions (“Terms”) carefully before using the booking services offered on the shirayuki.ski website (the “Service”) and participating in any snow activities, backcountry journeys, or powder expeditions.

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service. By making a booking, you agree to be bound by these Terms.

1. Roles and Nature of the Trips

“shirayuki.ski” refers to the brand and trading name belonging to the Monteluxe Collective, which promotes freeride activities, powder expeditions, and mountain experiences, acting as a booking and payment agent.

“Trip Coordinator” refers to the independent partner, host, or leader who accompanies the group to handle trip logistics, itinerary flow, accommodation, and group coordination on and off the snow.

“Client” refers to any individual or group making a booking through the Service.

2. Booking and Payment

2.1. Booking Process: All bookings are submitted online via shirayuki.ski. A booking is considered confirmed only upon receipt of full payment or the required deposit at checkout.

2.2. Pricing: Prices displayed on the site are in the currency specified at the time of transaction. shirayuki.ski reserves the right to adjust pricing at any time prior to booking confirmation.

2.3. Agency Fees and Administration: Online payments cover administrative overhead, marketing, concierge services, hosting, and booking management fees provided under the brand.

3. Cancellations and Refunds

3.1. Cancellation by the Client

Because payments cover platform organization, advance accommodation/partner deposits, and trip planning, no refunds will be issued for cancellations made by the Client for any reason, including but not limited to schedule changes, personal injury, illness, or non-attendance prior to or during the trip.

We strongly advise all Clients to obtain comprehensive personal travel, medical, and cancellation insurance. If an expedition or trip has not been paid in full and cancellation occurs within 7 days of the scheduled start date, the Client remains liable for the full agreed balance.

3.2. Cancellation by shirayuki.ski or the Trip Coordinator

In the event that an expedition or activity must be canceled due to force majeure, extreme weather, severe avalanche hazards, lift/infrastructure closures, or safety concerns, shirayuki.ski or the Trip Coordinator will attempt to reschedule the trip for an alternate date or provide a credit voucher for a future journey.

If rescheduling is not feasible, a refund for the activity portion (minus non-recoverable administrative and third-party booking costs) will be provided.

4. Client Obligations, Autonomy, and Safety

4.1. Independent Responsibility & Skill Level: Because trips are accompanied by a Coordinator and do not feature a certified mountain guide or instructor, each Client acts as an independent skier responsible for their own safety, line selection, and decision-making on the mountain. The Client must ensure they possess the necessary physical fitness and freeride proficiency for the chosen terrain.

4.2. Mandatory Safety Gear: The Client must arrive with appropriate, well-maintained skiing and safety equipment. For all off-piste and backcountry activities, avalanche safety gear (Transceiver/Beacon, Shovel, Probe) is mandatory. The Trip Coordinator reserves the right to exclude any Client from group riding who lacks the required safety gear.

4.3. Compliance with Trip Coordination: For group harmony, scheduling, and logistical safety, the Client must respect the group timetable and operational directions of the Trip Coordinator. The Trip Coordinator reserves the right to remove any Client whose behavior is reckless, unsafe, or disruptive to the group, without any entitlement to a refund.

5. Liability and Insurance

5.1. Assumption of Risk: Participating in freeride, off-piste skiing, and high-alpine journeys carries inherent risks (including avalanche hazards, rockfalls, hidden terrain obstacles, and sudden weather changes). By confirming a booking, the Client explicitly acknowledges these risks and agrees that they are skiing at their own risk without reliance on professional guiding services.

5.2. Personal Insurance: shirayuki.ski does not provide personal accident, medical, mountain rescue, helicopter evacuation, or equipment theft insurance. The Client is strictly required to hold valid personal liability, medical, and emergency mountain rescue insurance that covers off-piste skiing in the destination region.

5.3. Limitation of Liability: Operating solely as a commercial platform and trip organizer, shirayuki.ski disclaims all liability for personal injuries, property damage, loss of belongings, or field accidents. Clients accept full responsibility for their own actions while riding on the mountain.

6. Intellectual Property

6.1. Content Ownership: All materials published on the shirayuki.ski platform (including logos, text, graphics, photography, and site layout) are the exclusive property of shirayuki.ski or its licensors and are protected under applicable intellectual property laws.

6.2. Restrictions: Users are granted a limited, non-transferable license to access the platform for personal, non-commercial use. Any unauthorized reproduction, copying, or commercial exploitation of brand materials is strictly prohibited without prior written consent.

7. General Provisions

7.1. Severability: If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

7.2. Updates to Terms: shirayuki.ski reserves the right to modify these Terms at any time without prior notice. Revisions take effect immediately upon posting to the website. Continued use of the platform after updates constitutes acceptance of the modified Terms.
